A CARDENDEN family's argument about what to eat ended with a man in court.

William Kay Smart, 42, admitted that on February 26 at an address in Carden Castle Avenue, he acted in a threatening or abusive manner, and fought with his ex-partner and her daughter.

Dunfermline Sheriff Court heard last Wednesday that Smart and the woman had been in a relationship for about six months at the time of the offence.

Fiscal depute Louise Graham said: “An argument between the accused and the complainer escalated and the accused was asked to leave.

“It appears that during this argument, the witness grabbed the accused and tried to escort him out of the house.

“The accused struggled with her and her daughter. Police were contacted and the accused was traced.

“He was interviewed, cautioned and charge and made remarks that it was self-defence.”

Solicitor James Moncrieff said both parties had been drinking and that there had been an argument about what to eat in the course of the evening.

He added: “When she grabbed hold of him and tried to take him out of the property, the daughter got involved and matters spilled over.

“He suffered quite a few injuries himself and had 13 scratches to his face.

“During the interview, he explained what happened and when charged with assault, he said it was self-defence.

“Alcohol had been consumed by both parties and neither of them covered themselves in glory.”

He said Smart, of 11 Sir Jimmy Shand Court, Kirkcaldy, was no longer in a relationship with the woman.

Sheriff Craig McSherry deferred sentence until August 24 for Smart to be of good behaviour.
